Acceptance

The FloeTV service and network (collectively, all content and functionality available through the floe.tv domain name, the "FloeTV Website", or "Website") is provided to you subject to your agreement to (1) these Terms of Use and (2) FloeTV's Privacy Policy. FloeTV reserves the right to modify or revise these Terms of Use and/or its Privacy Policy at any time without notice, and you agree to be bound by such modifications or revisions. Violation of any of these Terms of Use will result in the immediate termination of your FloeTV account.

General Use of the FloeTV Website

• You are responsible for any activity that occurs under your FloeTV account.
• You are responsible for keeping your OpenID login credentials secure.
• You must not impersonate other FloeTV users.
• You must not abuse, harass, threaten, or intimidate other FloeTV users.
• You must not send unwanted email (Spam) to other FloeTV users.
• You may not use the FloeTV Website for any illegal or unauthorized purpose.
• You are responsible for your conduct and any content that you submit, post, or display on the FloeTV Website. Content includes, but is not limited to: data, information, text, usernames, sitenames, OpenIDs, graphics, photos, video clips, audio, and links.
• You must not modify or hack the FloeTV Website.
• You must not modify another website so as to falsely imply that it is associated with the FloeTV Website.
• You must not transmit any worms, viruses, or any other malicious code by means of the FloeTV Website.
• In using the FloeTV Website, you must not violate any laws in your jurisdiction. This includes, but is not limited to, copyright laws.
• All content on the FloeTV Website, except for user submitted content, including but without limitation, the text, software, scripts, graphics, photos, sounds, music, videos, interactive features, trademarks, and logos are owned by or licensed to FloeTV, subject to copyright and other intellectual property rights under the law.

You understand and agree that FloeTV does not and cannot review all content submitted or created by users accessing the FloeTV Website, and that FloeTV is not in any manner responsible for any content submitted or created by users accessing the FloeTV Website. You further understand and agree that you may be exposed to user submitted content that is inaccurate, offensive, indescent, or objectionable and that you are using the FloeTV Website at your own risk. You agree to waive, and hereby do waive, any legal or equitabe rights or remedies you have or may have against FloeTV with respect thereto, and agree to indemnify and hold FloeTV, its Owners/Operators, affiliates, and/or licensors, harmless to the fullest extent allowed by law regarding all matters related to your use of the FloeTV Website.

Copyright

FloeTV is commited to obey all relavent copyright laws, and will review all claims of copyright infringement received. FloeTV will remove all content deemed to have been posted or distributed in violation of any such laws. To make a claim of copyright infringement, please send the following information to copyright@floe.tv:

• A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner;
• A description of the copyrighted work claimed to have been infringed;
• A description of the infringing material and information reasonably sufficient to permit FloeTV to locate the material;
• Information reasonably sufficient to permit FloeTV to contact you, including your name, physical address, telephone number, and email address;
• A statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
• A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Other Conditions

• FloeTV reserves the right to refuse service to anyone for any reason at any time.
• FloeTV may, at any time and for any reason, remove any user submitted content from the FloeTV Website.
• FloeTV reserves the right to remove any FloeTV account from the FloeTV Website for any reason at any time.
• Any sitename used on the FloeTV Website may be reclaimed by FloeTV for any reason at any time.
